This notice explains how Ami Markt handles your personal data when you visit our shop, place an order or write to us. It follows the Swiss Federal Act on Data Protection (FADP) and, for visitors from the EU and Liechtenstein, the General Data Protection Regulation (GDPR).
At a glance
- We use your data to run the shop, process your orders and answer your messages.
- We do not sell your data.
- Statistics and advertising cookies are only used if you agree.
- We are based in the USA, so your data is processed there.
- You can ask at any time what we store about you, and have it corrected or deleted.
Who is responsible
Ami Markt is an online shop operated by OSE Enterprises, LLC, Bixby, Oklahoma, USA. We are responsible for the processing of your personal data on this website. For any privacy question, write to us at kontakt@amimarkt.ch.
What data we process and why
- Orders: name, delivery and billing address, email, phone number, items ordered and amounts, to process and deliver your order and clear it through customs.
- Payment: payment method and transaction details. Card details are handled by the payment provider; we never see them.
- Customer account: if you create one, your login details, addresses and order history.
- Messages: what you send us through the contact form or by email, and our replies.
- Newsletter: your email address, only if you sign up. Every email has an unsubscribe link.
- Use of the website: IP address, device, browser, pages viewed and cookies, to run and protect the shop and, only with your consent, for statistics and advertising.
- Legal duties: accounting and tax records and the information needed for customs declarations.
We do not make decisions about you that are based solely on automated processing.
Legal basis under the GDPR
If the GDPR applies to you, we rely on:
- performance of a contract (Art. 6(1)(b) GDPR) for orders and your customer account,
- legal obligations (Art. 6(1)(c) GDPR) for accounting and customs,
- our legitimate interest (Art. 6(1)(f) GDPR) in running the shop securely and answering your messages,
- your consent (Art. 6(1)(a) GDPR) for the newsletter, statistics and advertising.
Under Swiss law, we process your data in line with the principles of the FADP: lawfully, proportionately and only for the purposes described here.
Who receives your data
We only share data where it is needed for the purposes above:
- Shopify, our shop platform, for hosting, checkout, payment processing and sending emails.
- Shipping companies and customs authorities, for delivery and customs clearance: name, address, phone number, email, description and value of the goods.
- Payment providers that process your payment at checkout.
- Email and IT providers that host our mailbox, send service emails and run our internal order tools.
- Google, for Google Ads (measuring which of our ads lead to purchases) and Google AdSense (showing ads on our site), only if you agree to statistics or advertising cookies. Google also uses this data for its own purposes as an independent controller; see how Google uses data from partner sites.
- Authorities, where the law requires it.
Our service providers may only use your data on our behalf and for these purposes. We do not sell or rent your data.
Data processed outside Switzerland
We are a company based in the USA, so your data is processed in the USA. Shopify also stores data in Canada, and our email mailbox is hosted in Switzerland. Switzerland and the EU recognise Canada as providing adequate data protection. For the USA, we rely on our providers' certification under the Swiss-U.S. and EU-U.S. Data Privacy Framework where available, and otherwise on standard contractual clauses. When you order from us, sending your data to us in the USA is necessary to perform our contract with you. Shipping and customs data also go to the countries your parcel passes through.
Cookies
Necessary cookies, for example for the cart, checkout and security, are always set because the shop does not work without them. Statistics and advertising cookies, such as those of Google Ads and Google AdSense, are only set if you agree in the cookie banner. If you agree, Google may show you ads based on your interests; if you don't, you may still see ads that are not personalised. We do not collect anything beyond what these Google services collect themselves.
You can change your choice at any time: delete the Ami Markt cookies in your browser and the banner will ask you again on your next visit. You can also block cookies in your browser settings, but some parts of the shop may then stop working.
How long we keep data
- Order and accounting records: as long as the law requires, usually 10 years.
- Customer account: until you delete it or ask us to.
- Messages: as long as we need them to handle your request.
- Newsletter: until you unsubscribe.
- Statistics: only as long as we need them for evaluation.
Your rights
At any time and free of charge, you can:
- ask what data we hold about you,
- have incorrect data corrected,
- have your data deleted, unless the law requires us to keep it,
- receive your data in a common electronic format,
- object to the use of your data for advertising and withdraw any consent,
- under the GDPR, also ask us to restrict the processing of your data.
Just write to kontakt@amimarkt.ch. We reply within 30 days and may ask you to confirm your identity. You can also lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or, in the EU and Liechtenstein, with the data protection authority of your country.
Data security
We send data over encrypted connections (HTTPS). Only people who need customer data to process orders have access to it.
